1. The Service

MonetiseOS is an AI-powered platform that helps users research content creators and generate digital product plans, marketing copy, launch plans, and outreach pitches. We may add, change, or remove features at any time.

2. Eligibility and Accounts

You must be at least 16 years old to use the Service. By creating an account you confirm that you meet this requirement.

You are responsible for everything that happens under your account, including keeping your credentials secure and not sharing access with anyone else. Notify us at hello@monetiseos.com if you suspect any unauthorised access.

3. Subscriptions, Billing, and Payment

The Service is offered on a paid subscription basis. Current plans and prices are shown on our website and in your account.

Subscriptions renew automatically each billing cycle until cancelled. Payments are processed by our payment provider. We may change our prices at any time and will provide notice of any change before it takes effect on your subscription. Prices are exclusive of any applicable taxes unless stated otherwise.

4. No Refunds

All payments are final and non-refundable. This includes payments for partial billing periods, unused time, downgraded plans, and cancellations made mid-cycle. By starting a subscription and using the Service, you acknowledge and agree to this no-refund policy.

You can cancel your subscription at any time. When you cancel, you retain access until the end of your current billing period.

This clause does not affect any rights you may have under applicable consumer protection laws that cannot be excluded.

5. Acceptable Use

You agree not to use the Service:

• For any unlawful, fraudulent, harmful, or abusive purpose.
• To harass, defame, impersonate, or violate the rights of any person, including any creator whose publicly available content is analysed through the Service.
• To generate or distribute content that is illegal, infringing, defamatory, or that promotes violence, hate, or discrimination.
• To reverse-engineer, scrape, decompile, or copy the Service or any part of it.
• To gain or attempt to gain unauthorised access to the Service, other users' accounts, or our infrastructure.
• To interfere with the normal operation of the Service, including through excessive automated requests.
• To resell, sublicense, or re-host the Service or its outputs as a competing product.

We may suspend or terminate your account if we reasonably believe you are violating these rules.

6. AI-Generated Outputs — Important Disclaimers

You acknowledge and agree that:

• The Service uses artificial intelligence to generate outputs. AI-generated content may be inaccurate, incomplete, outdated, biased, or otherwise unsuitable for your purposes.
• The Service may produce similar or identical outputs for different users.
• Outputs are provided "as is" with no warranty of any kind, including no warranty of accuracy, originality, fitness for a particular purpose, or commercial result.
• You are solely responsible for reviewing, editing, fact-checking, verifying, and exercising your own judgement before relying on, publishing, or otherwise using any output.
• We make no representation, warranty, guarantee, or promise that use of the Service or its outputs will result in any particular business outcome, financial result, audience growth, sales, revenue, or success of any kind.

Your use of the Service and any output from it is entirely at your own risk.

7. Your Content and Outputs

You retain ownership of the inputs you submit. Subject to your compliance with these Terms and payment of applicable fees, you may use the outputs generated for you for your own purposes, including commercial use.

You are solely responsible for ensuring that your inputs, your use of outputs, and any analysis you perform using the Service complies with applicable laws, third-party rights, and the terms of any platform whose content is referenced.

8. Our Intellectual Property

The Service itself — including its code, design, branding, prompts, and underlying systems — is owned by ApeTec Ltd and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to access and use the Service in accordance with these Terms. Nothing in these Terms transfers ownership of the Service to you.

9. Third-Party Services

The Service relies on third-party providers. We are not responsible for the availability, performance, accuracy, or conduct of those providers, or for any consequences arising from their use.

Third-party trademarks, service marks, trade names, and logos referenced on the Service (including Whop, YouTube, Instagram, and Gumroad) are the property of their respective owners. The Service is not affiliated with, endorsed by, or sponsored by these third parties.

10. Availability

We aim to keep the Service available but do not guarantee uninterrupted access. The Service may be unavailable from time to time for maintenance, upgrades, or reasons outside our control. We are not liable for any unavailability of the Service.

11. Disclaimer of Warranties

To the fullest extent permitted by law, the Service and all outputs are provided "as is" and "as available", without warranties of any kind, express or implied. We disclaim all warranties including, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, security, or that the Service will be uninterrupted or error-free.

You assume all risk arising from your use of the Service and any output.

Nothing in these Terms excludes any liability that cannot be excluded under applicable law.

12. Limitation of Liability

To the fullest extent permitted by law:

• We will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost opportunities, lost data, business interruption, or loss of goodwill, whether based in contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.
• Our total aggregate liability to you, for any and all claims arising out of or relating to the Service or these Terms, will not exceed the greater of (a) the amount you paid us in the three months immediately before the event giving rise to the claim, or (b) £100.

These limitations apply regardless of the legal theory on which the claim is based and to the fullest extent permitted by law.

13. Indemnity

You agree to indemnify, defend, and hold harmless ApeTec Ltd and its directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any law or any third-party right (including intellectual property, privacy, and publicity rights).
• Your inputs to the Service or your use of any outputs produced by the Service.

14. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms or if you fail to pay any fees due.

On termination, your right to use the Service ends immediately. Sections 4, 6, 7, 8, 11, 12, 13, 14, 15, and 16 survive termination.

15. Governing Law and Disputes

These Terms are governed by the laws of England & Wales. Any dispute arising out of or relating to these Terms or the Service is subject to the exclusive jurisdiction of the courts of England & Wales, except where mandatory consumer protection law in your country of residence provides otherwise.

16. Changes to These Terms

We may update these Terms from time to time. The most current version will always be available at this URL, and the "Last updated" date below will reflect the latest version. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
